License Agreement
Effective Date: May 26, 2025
This License Agreement ("Agreement") governs your use of music and content distributed through Tchaikovsky ("we," "us," or "our"), operated by Broken Duck Media Co., Ltd.
1. Grant of License
By purchasing or accessing music through Tchaikovsky, you are granted a non-exclusive, worldwide, royalty-free license to use the music in accordance with the specific license type selected at the time of purchase or publication.
2. License Types
Tchaikovsky offers various license types, including but not limited to:
- Creative Commons (CC BY, CC BY-NC, CC0): Permits use under defined conditions such as attribution or non-commercial use.
- All Rights Reserved: Full copyright retention; no reuse without explicit permission.
- TSCAI License: Custom license granting Tchaikovsky rights to redistribute, remix, and transform your music within our platform ecosystem.
3. Restrictions
Unless explicitly permitted by the license type, you may not:
- Use the music in a way that violates copyright laws or infringes on the rights of others.
- Redistribute, resell, or sublicense the music without proper authorization.
- Use the music for unlawful or defamatory purposes.
4. Ownership
The original creator retains ownership of the music. The license only grants usage rights as specified.
5. Indemnification
You agree to indemnify and hold harmless Broken Duck Media Co., Ltd., its affiliates, and licensors from any claims, damages, or liabilities arising from your use of the music in violation of this Agreement.
6. Termination
Violation of any terms of this Agreement may result in termination of your license and access to the music.
7. Changes to the Agreement
We reserve the right to modify this Agreement at any time. Updates will be posted on this page with the effective date.
